198. This Panel has heard criticism of the language of the Terms of Reference which set the parameters and fundamentally affected the outcome of the investigation. For instance, it is complained that the word “rumour” was used. But that is the wording and the language used by the complainant Hasson, when he wrote to Achmat – that there were “rumours” and that “ it is rumoured”. Hasson made it clear from the outset that he had no facts to place before Achmat (and later the Human Resources Subcommittee) and that he had heard only “rumours” from two persons – ‘KR’ and ‘KS’.

In contrast, an exhibition of true “secularism” would be open-ended, either agnostic or, at the other extreme, in a country like India where faith is so central, multi-religious. Most importantly, at its heart, true secularism would be driven by universal values of truth, compassion and equality, which are fundamental values that straddle all religions.

Meltblown nonwovens are relatively inexpensive and existing specifications can be used without the need for expensive and lengthy modification to production protocol. A thermoplastic fibre-forming polymer is extruded via a linear die containing hundreds of small orifices. Convergent streams of hot air rapidly attenuate the extruded polymer streams to form extremely fine diameter fibres which are collected on a conveyor, where an autogenously-bonded meltblown nonwoven is formed. The fibres in the meltblown web are bonded by a combination of entanglement and cohesive sticking.

There may be many highly personal and private reasons for not wanting to participate in a process where the kernel of the enquiry is that one disclose and discuss one’s private, intimate, sexual life. Similarly, there may be reasons why some people do not wish to reveal events or personal interactions which were or remain hurtful or distressing even though they do not constitute sexual harassment or misconduct and do not want to divulge their identities to those against whom they are making complaints.
